Privacy Policy of Limitless by Autopay

(hereinafter referred to as “Privacy Policy“)

This privacy policy sets out the basic principles for the processing of personal data by SAIL-PIOTR PRZYBYLSKI (hereinafter referred to as “SAIL-PIOTR PRZYBYLSKI“) based in Lewald Wielki i.e. the provider of the Limitless by Autopay service, as the administrator of your Personal Data, including in particular:

  • Specifies the purpose, scope and duration of the processing of Personal Data by SAIL-PIOTR PRZYBYLSKI under the Limitless by Autopay service and on the service belonging to SAIL-PIOTR PRZYBYLSKI,
  • describes the rights you have as a result of the processing of your Personal Data by SAIL-PIOTR PRZYBYLSKI,
  • contains other information about the processing of Personal Data by SAIL-PIOTR PRZYBYLSKI, which is required by the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data (General Data Protection Regulation) – “hereinafter referred to as the RODO“,
  • Regulates the rules of use of cookies by SAIL-PIOTR PRZYBYLSKI.

1 Definitions

1) Administrator – Piotr Przybylski conducting a sole proprietorship under the business name “SAIL-PIOTR PRZYBYLSKI” with registered office: Lewałd Wielki 31, 14-120 Dąbrówno, NIP: 7411840231, REGON: 280090196;

2) Personal data – information about an identified or identifiable natural person referred to in Article 4(1) of the RODO, i.e. all information concerning you (in particular, your name, home address, e-mail address and telephone number) that you personally provide to the Administrator, or that the Administrator obtains from other sources;

3) Cookies – IT data recorded by web servers and stored on the Device;

4) Device – computer, phone, tablet or other telecommunications terminal device through which you access the Service;

5) Regulations – “Regulations for the use of the sauna area and sprinkler platform within Limitless by Autopay” containing the rules for the provision of services by the Administrator, available at: https://sopotlimitless.pl/,

6) Service – Internet service available at: https://sopotlimitless.pl/.

2 Processing of Personal Data

information required pursuant to Article 13 of the RODO

1) The administrator of your Personal Data is Piotr Przybylski conducting a sole proprietorship under the name “SAIL-PIOTR PRZYBYLSKI”.

2) You can contact the Administrator:

  • via email sent to: przybylski.piotr@wp.pl,
  • by mail to the address: SAIL-PIOTR PRZYBYLSKI, Lewałd Wielki 31, 14-120 Dąbrówno.

3) The Administrator processes your Personal Data for the purposes described below:

  1. To enable you to use the Administrator’s services provided under the terms described in the Regulations,
  2. Monitoring your activity on the Website using Cookies,
  3. profiling your interests using Cookies to tailor the content of the Service and the Administrator’s commercial and marketing information to you,
  4. to reach you by means of Cookies made available on external services, with advertising messages tailored to you, prepared as a result of your use of the Website,
  5. in the case of your separate consent – to provide direct marketing of the Administrator’s products or services, including the transmission of commercial information, including, but not limited to, in the form of a newsletter, or use the contact form to make a marketing phone call.

4) The legal basis for the administrator’s processing of Personal Data is:

  1. in the cases indicated in point 3) i and v above – your voluntarily given consent,
  2. in the cases indicated in point 3) ii, iii and iv above – realization of the Administrator’s legitimate interest in conducting marketing activities or your voluntarily granted consent to the use of cookies.

5) The Administrator shall process Personal Data in accordance with generally applicable data protection regulations, in particular in accordance with the RODO.

6) The Administrator processes the following Personal Data:

  • in case you want to use the Administrator’s services under the terms described in the Regulations, in particular by buying a ticket, making a reservation of the date of performance of a selected service or signing up for an event organized by the Administrator – name and surname, telephone number, e-mail address, payment details,
  • if the Administrator’s services are used under the terms described in the Regulations by a person who is at least 1 year old, but under 18 years of age – the name and surname, date of birth of the minor, as well as the name and address of residence of his parent or legal guardian,
  • in case you are interested in the Administrator’s services and commercial information, as well as if you want to receive newsletters with promotions and offers, or if you use the contact form – your name and e-mail address and optionally a telephone number (only if you provide them),
  • When using the Website – IP address, domain, operating system type and browser identification data.

7) The Administrator may transfer Personal Data to entities providing hosting services, postal services, payment operators, entities providing marketing services to the Administrator – only after concluding a proper agreement on entrusting the processing of personal data.

The Administrator may also provide Personal Data to entities authorized to obtain them under generally binding laws.

The Administrator declares that it will not transfer Personal Data outside the European Economic Area in any of the cases described above.

8) The Administrator will process Personal Data:

  1. in the case indicated in point 3) i above – for the time necessary for the Administrator to perform the ordered service for you,
  2. in the cases indicated in point 3) ii, iii and iv above – as long as the legitimate interest of the Administrator lasts, however, in case Personal Data is processed under profiling, the Administrator will process it no longer than until you object to such processing,
  3. in the case indicated in point 3)(v) above – until you withdraw your consent to the processing of Personal Data.

9) The Administrator, if possible, will have the ability to make automated decisions with respect to you, including profiling. This will not have any legal effect on you or materially affect you.

Profiling involves the processing of Personal Data by using it to analyze your personal preferences and personal interests. As a result of profiling, you may not be able to access certain content that the Administrator believes may be unsuitable for you.

10) Any Personal Data you provide is voluntary, however, some of your Personal Data may be necessary for:

  • to perform the service for you in accordance with the Regulations,
  • or for the proper use of the Service.

3. rights related to the processing of Personal Data

In connection with the processing of Personal Data by the Administrator, you have the rights provided for in the RODO:

(a) the right to know what Personal Data is processed by the Administrator and to receive a copy of that data (the so-called right of access);

(b) the right to rectify your Personal Data if it becomes outdated or incomplete (or otherwise incorrect);

(c) the right to immediate deletion of your Personal Data by the Administrator in the following cases:

  • if the Data is no longer needed by the Administrator for the purposes of processing as specified in the Privacy Policy,
  • as a result of effective withdrawal of consent for processing of Personal Data (unless there is no other legal basis justifying its processing by the Administrator),
  • If the Administrator’s processing of your Personal Data is not lawful,
  • if the need to delete Personal Data arises from a legal obligation of the Administrator;

(d) the right to transfer Personal Data to another data controller;

(e) the right to restrict the processing of Personal Data, i.e. to request not to perform any operations on the Personal Data, but only to store them, for a certain, necessary time in the situation of objecting to the processing or in the event that it is determined that:

  • The Administrator no longer needs certain categories of Personal Data,
  • processed Personal Data is incorrect,
  • processing of Personal Data is unlawful;

(f) The right to object to the processing of Personal Data for marketing activities that the Administrator may carry out on the basis of a legally described legitimate interest, so that, as a consequence of such objection, the Administrator stops processing Personal Data;

(g) the right to withdraw consent to the processing of Personal Data for the purpose of providing information about the Administrator’s own products and services (direct marketing by the Administrator) with such effect:

  • processing that was carried out before the revocation of consent will not cease to be lawful,
  • Whereas, once consent is withdrawn, the Administrator will no longer process Personal Data for the purposes for which consent was given.

  1. You also have the right to file a complaint with the President of the Office for Personal Data Protection at any time if you believe that the Administrator’s processing of your Personal Data violates the provisions of the RODO.

4 Cookies

1) The Administrator informs you that during your use of the Website, it may use Cookies for the purpose of:

  • Sending certain information to the Device,
  • storage of information on the said Device,
  • To access information stored on the Device.

2) The Administrator further informs that the Cookies used by him:

  • Are safe for the Device, are not viruses or other unwanted or malicious software;

  • allow the Administrator to access only specific information previously sent by the Administrator and stored on the Device;

9) As a result of the Administrator’s actions described in point 8) above, you may see its advertisements on the listed services. The rules on whether or not to consent to the use of Cookies and to withdraw consent by changing browser settings described in Section 6) above also apply.
